Buyer bears the sole responsibility to remove the items purchased in a safe and professional manner and Buyer agrees to accept all liability for any damages to persons and/or property caused during such removal, whether caused by Buyer’s negligence or not. In addition, purchaser shall be liable for any rent incurred or damages suffered by auctioneer because of purchaser’s failure to timely remove any lot. If for any reason the purchaser fails to remove any lot within the time specified, the lot shall be deemed abandoned, and the auctioneer may re-sell, or remove from auction site and/or store the said lots at purchaser’s sole risk and expense.
Removal of all items shall be at the expense, risk and liability of the purchaser and in a manner approved by auctioneer. All lots must be removed within the time announced or posted at the sale. Neither the Auctioneer nor its principal(s) shall be held liable with respect to any item sold in any greater amount than that paid by the purchaser and, in all instances, the highest bid shall be accepted by both the buyer and principal(s) as the value against which all claims for loss or damage shall lie.ģ). Auctioneer shall not, in any event, be liable for non-delivery or for any other matter or thing, to any purchaser of any lot, other than for the return to the purchaser of the deposit or sum paid on said lot, should the purchaser be entitled thereto.
